BODYKEYTM Privacy Policy

A. This Privacy Policy describes how the Amway Affiliates listed in Paragraph 10(hereinafter “Amway”, “us”, “our" or “we”) uses Personal Information, as defined below, collected or received from you, the users (“Users” or “you”) of the BodyKey Program.

B. It describes how we may collect or receive your Personal Information, the types of information we may collect, hold, how we use, share, disclose and protect this Personal Information, how long we retain this Personal Information, your rights, and how you can contact us about our privacy practices.

C. By providing us with your Personal Information, and by having access to this Policy, you consent to our collection, use and disclosure (including transfer) of your Personal Information in accordance with this Privacy Policy. YOUR MUST NOT PROVIDE ANY PERSONAL INFORMATION TO AMWAY IF YOU DO NOT ACCEPT THIS PRIVACY POLICY.

1. How We May Collect or Receive Personal Information from You

Wherever possible, we collect Personal Information directly from you.

a. Registration. We collect your Personal Information when you install the BodyKey mobile application (“App”),and register for an account in order to join the BodyKey Program.

b. Logged in as User. If you are logged in on the App as a User, we may collect your Personal Information from you. For example, we may collect your Personal Information when you update your personal information.

c. Activity Tracking. When wearing the InBodyBAND wristband, data about your activity (such as your step count) will be collected and available to you and Amway via the App.

d. Other forms of contacting us. You may also choose to submit your Personal Information and other information to us or our service providers through various communication channels, such as,e-mail, telephone or online forms.

2. How we Hold and Protect Personal Information

At all times, we will maintain appropriate technical and organizational security safeguards designed to protect the Personal Information you provide against accidental, unlawful, unintended or unauthorized destruction, loss, alteration, access, disclosure or use. However, we cannot be held responsible for any accidental, unlawful, unintended or unauthorized destruction, loss, alteration, access, disclosure or use of Personal Information that is beyond our control.

We are committed to keeping your Personal Information secure and will use all reasonable precautions to protect it from interference, loss, misuse or unauthorised modification, including:

a. Securing external and internal premises;

b. Restricting access to your Personal Information to employees or those who perform services on our behalf who are authorised to handle your Personal Information and on a 'need to know' basis;

c. Entering into confidentiality agreements with relevant employees and third parties;

d. Appropriate training of staff;

e. Retaining your Personal Information for no longer than it is reasonably required to meet the purposes described in this Policy;

f. Taking reasonable steps to destroy or de-identify Personal Information that is no longer required.

3. The Types of Personal Information We May Collect

a. ”Personal Information” is information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual, or an individual who is reasonably identifiable. ThePersonal Information we may collect from you includes but is not limited to:

i. Contact information (e.g., first name, last name, postal/delivery address, e-mail address, fax number and phone number/s);

ii. Gender;

iii. Age and date of birth;

iv. Body measurements (e.g. height and weight);

v. Weight goal;

vi. Username and password; and

vii. Information on physical activity such as step count.

b. Your provision of Personal Information to us is voluntary. However, if you choose not to provide us with the Personal Information we require, you may not be able to use the App or take part in the BodyKey Program. Further, it may not be possible for us to contact you or to provide products or services in connection with the BodyKey program.

c. If you provide us with the Personal Information of anyone other than yourself, you warrant that you have informed him/her of the purposes for which we are collecting his/her Personal Information and that he/she has consented to your disclosure of his/her Personal Information to us for those purposes, and for our use of his/her Personal Information in accordance with this Privacy Policy.

4. How We Use the Personal Data We Collect

a. Primary purposes.Generally, we collect, use or disclose your Personal Information for the following purposes to:

i. manage your BodyKey registration;

ii. create and manage your account and respond to your inquiries;

iii. provide suggestions on nutrition and physical activities;

iv. communicate with you;

v. allow interaction between you and other Users and/or visitors of the App (depending on your profile settings);

vi. facilitate your use of the App through the use of cookies (e.g. to remember ‘log in’ details);

vii. improve the App, including tracking and monitoring your use of the App through the use of cookies, and to diagnose problems with the software or hardware we use; and

viii. any other reasonable purposes related to the aforesaid.

b. Business purposes. We may also use your Personal Informationfor secondary purposes connected or relevant to our business, such as:

i. complying with our legal obligations and requirements;

ii. enforcing contractual terms and conditions;

iii. accounting, risk management and record keeping;

iv. performing research and statistical, marketing and businessanalysis; and

v. any other reasonable purposes related to the aforesaid.

5. How We May Share or Disclose Personal Information

a. We will not sell, rent, trade, transfer or exchange your Personal Information without your consent.

b. We may disclose your Personal Information to related companies and third party service providers

c. You agree that we may disclose or share your Personal Information with other entities within the Amway affiliated group and our strategic business partners and associates to whom it is reasonably necessary or desirable for us to disclose your Personal Information. They will use your Personal Information only for the purposes you have consented to in this Privacy Policy.

d. You agree that we may disclose your Personal Informationto third parties who provide necessary services to us, allowing us to perform activities in connection with the purposes described in this Policy, such as:

i. service providers and data processors working on our behalf and providing services to us such as hosting and maintenance services, compilation and storage services, analysis services, e-mail message services, delivery services etc.; and

ii. our consultants (such as nutritionists, health experts etc) and professional advisors (such as accountants, lawyers, auditors, etc).

We require any third party to whom your Personal Information is disclosed to keep the information confidential and only use it for the same purposes we are permitted to use it in line with this Policy.

e. You agree that we may also disclose your Personal Informationto Government authorities or other third parties, if required by law or reasonably necessary to protect the rights, property and safety of others or ourselves.

6. Transfer of Personal Informationout of Local Jurisdiction

a. Some organisations to which Amway will disclose personal information are located outside your local jurisdiction.

b. You fully understand and unambiguously consent that we may transfer your Personal Information to any location outside of the local jurisdiction, such as the United States, New Zealand, the Republic of Korea, Malaysiaor other jurisdictions, for the purposes set out above in this Privacy Policy.

c. If we transfer your Personal Information to a country or territory outside of the local jurisdiction, we will ensure that the recipient of the Personal Information provides a standard of protection that is comparable to the protection which your Personal Information enjoys under the laws of the local jurisdiction. Where these countries or territories do not have Personal Information protection laws which are comparable to that in the local jurisdiction, we will enter into legally enforceable agreements with the recipients to ensure that they protect your Personal Information to the same standard as required under the laws of the local jurisdiction.

7. How Long We Retain Personal Data

a. We will store yourPersonal Information for as long as necessary to fulfil the purposes for which we collect the data (see above under “How We Use the Personal Data We Collect”), except if required otherwise by law.

8. Updates to the Privacy Policy

a. We reserve the right to change this Privacy Policy at any time. The changes will come into effect on the effective date that is stated in the updated Privacy Policy.

b. The updated Privacy Policy will supersede all earlier versions and will apply to all Personal Information provided to us previously. The updated Privacy Policy will be made available upon request from us.If you do not accept any changes made to the Privacy Policy, please contact us by making a written request using our contact details set out in paragraph 24 below.

9. Your Rights to Access and Correct Your Personal Data and Complaints

a. Your rights under applicable law include access to the Personal Information we hold about you, the right to have such Personal Information confirmed, amended,corrected, erased or blocked. You also have the right to withdraw your consent. To exercise these rights, you should make a written request using our contact details set out in paragraph 10below.

b. In many circumstances, we need to use your Personal Information in order for us to provide you with products or services which you may require. If you do not provide us with the required Personal Information, or if you withdraw your consent to our use and/or disclosure of your Personal Information for these purposes, it may not be possible for us to continue to serve you or provide you with the products and services that you may require.

c. You also have the right to complain about how your personal information has been handled. If you wish to make a complaint, please provide a written complaint to us at the contact details set out in paragraph 10below. Amway will respond in writing within 30 days of receipt of a complaint.

i. IN AUSTRALIA, if the complaint remains unresolved, you have the option of notifying the Office of the Australian Information Commissioner (OAIC). Contact detail can be found at the OAIC’s website: www.oaic.gov.au.

10. Allow to Use Google Fit https://www.googleapis.com/auth/fitness.activity.read and https://www.googleapis.com/auth/fitness.location.read to receive the step and distance information of Google activity data to calculate further information about your activity, such as distance run through Bodykey app and sync the changes with Google fit. so you will check the details of daily step information in the Bodykey app.

ค. ทำสัญญา/ข้อตกลงเรื่องการรักษาความลับกับพนักงานและบุคคลที่สามที่เกี่ยวข้อง

ง. ให้การฝึกอบรมแก่พนักงานอย่างเหมาะสม

จ. เก็บรักษาข้อมูลส่วนบุคคลของคุณไม่นานเกินกว่าระยะเวลาที่เหมาะสมดังระบุในนโยบายฉบับนี้

ฉ. ใช้วิธีที่ถูกต้องเหมาะสมในการทำลายหรือระงับการเชื่อมต่อของข้อมูลส่วนบุคคลของคุณที่ไม่จำเป็นต้องเก็บรักษาอีกต่อไป

3. ประเภทของข้อมูลส่วนบุคคลที่เราจะเก็บ

ก. “ข้อมูลส่วนบุคคล” คือ ข้อมูลหรือความคิดเห็น ไม่ว่าจะถูกต้องหรือไม่ และไม่ว่าจะได้รับการบันทึกในเอกสารหรือไม่ โดยเป็นเรื่องราวที่มีการระบุตัวตน หรือสามารถตรวจสอบว่าเป็นบุคคลที่มีตัวตน ข้อมูลส่วนบุคคลที่เราขอจากคุณอาจรวมถึง แต่ไม่จำกัด ดังต่อไปนี้

ข. การให้ข้อมูลส่วนบุคคลของคุณแก่เราเป็นความสมัครใจ หากคุณไม่ให้ข้อมูลส่วนบุคคลแก่เรา เราจะไม่สามารถติดต่อคุณหรือให้คุณใช้แอพพลิเคชั่น หรือเข้าร่วมโครงการบอดี้คีย์ หรือให้ผลิตภัณฑ์หรือบริการที่คุณต้องการจากเรา

ค. หากคุณให้ข้อมูลส่วนบุคคลของบุคคลอื่นที่ไม่ใช่ตัวคุณ คุณจะต้องยืนยันว่า คุณได้แจ้งให้ เขา/เธอ ทราบวัตถุประสงค์ที่เราเก็บข้อมูลส่วนบุคคลของ เขา/เธอ และบอกให้ เขา/เธอ ยินยอมให้เปิดเผยข้อมูลส่วนบุคคลของ เขา/เธอ แก่เรา เพื่อวัตถุประสงค์ดังกล่าว และสำหรับการใช้ข้อมูลส่วนบุคคลของงานของ เขา/เธอ ตามนโยบายความเป็นส่วนตัว

4. วิธีการที่เราใช้ข้อมูลส่วนบุคคล

ก. วัตถุประสงค์หลัก โดยทั่วไปเราเก็บ ใช้หรือเปิดเผยข้อมูลส่วนบุคคลของคุณ เพื่อวัตถุประสงค์ดังต่อไปนี้:

vii. ปรับปรุงแอพพลิเคชั่น รวมถึงติดตามและตรวจสอบการใช้แอพพลิเคชั่น ผ่าน cookies และการวิเคราะห์ปัญหาเกี่ยวกับซอฟแวร์หรือฮาร์ดแวร์ที่เราใช้ และ

viii. วัตถุประสงค์ที่เหมาะสมอื่นๆ ที่เกี่ยวข้อง

ข. วัตถุประสงค์ทางธุรกิจ เราอาจจะใช้ข้อมูลส่วนบุคคลของคุณ เพื่อวัตถุประสงค์ที่เกี่ยวโยงกันหรือที่เกี่ยวข้องกับธุรกิจของเรา เช่น:

i. ปฏิบัติตามข้อผูกพันทางกฎหมายและข้อกำหนดของเรา

ii. บังคับใช้ข้อตกลงตามสัญญาและเงื่อนไข

iii. การบัญชี การบริหารความเสี่ยงและเก็บบันทึกข้อมูล

iv. ดำเนินการวิเคราะห์ทางสถิติและการวิจัยทางวิทยาศาสตร์ และ

v. วัตถุประสงค์ที่เหมาะสมอื่นๆ ที่เกี่ยวข้อง

5. วิธีการแบ่งปันและเปิดเผยข้อมูลส่วนบุคคล

ก. เราจะไม่ขาย ให้เช่า โอนหรือแลกเปลี่ยนข้อมูลส่วนบุคคลของคุณโดยไม่ได้รับความยินยอมจากคุณ

ข. เราอาจเปิดเผยข้อมูลส่วนบุคคลของคุณให้แก่บริษัทที่เกี่ยวข้องและบุคคลที่ให้บริการ

ค. คุณยอมรับว่า เราอาจเปิดเผยหรือแบ่งปันข้อมูลส่วนตัวของคุณกับหน่วยงานอื่นๆ ในกลุ่มแอมเวย์ บริษัทในเครือและพันธมิตรทางธุรกิจเชิงกลยุทธ์ของเรา และเพื่อนร่วมงานที่จำเป็นต้องเปิดเผยข้อมูลส่วนตัวของคุณ ซึ่งจะใช้ข้อมูลส่วนบุคคลของคุณเพื่อวัตถุประสงค์ที่คุณได้ยินยอมให้ในนโยบายความเป็นส่วนตัวเท่านั้น

ง. คุณยอมรับว่า เราอาจเปิดเผยข้อมูลต่อบุคคลที่สามที่ให้บริการที่จำเป็นแก่เรา เช่น:

ก. ที่ต้องของบางองค์กร/หน่วยงานที่แอมเวย์จะเปิดเผยข้อมูลส่วนบุคคลอยู่นอกเขตอำนาจของท้องถิ่น

ข. คุณเข้าใจและยินยอมว่า เราอาจถ่ายโอนข้อมูลส่วนบุคคลของคุณไปยังสถานที่ใดๆ ที่อยู่นอกเขตอำนาจของท้องถิ่น เช่น สหรัฐอเมริกา สาธารณรัฐเกาหลี หรือเขตอำนาจอื่นๆ เพื่อวัตถุประสงค์ที่ระบุไว้ในนโยบายความเป็นส่วนตัวข้างต้น

ค. หากเราถ่ายโอนข้อมูลส่วนบุคคลของคุณไปยังประเทศ หรือดินแดนที่อยู่นอกเขตอำนาจท้องถิ่นที่เรามั่นใจว่า ผู้รับข้อมูลส่วนบุคคลมีมาตรฐานการปกป้องข้อมูลเทียบเท่าการคุ้มครองข้อมูลส่วนบุคคลของคุณ ภายใต้กฎหมายของอำนาจของท้องถิ่น ในกรณีที่ประเทศ หรือดินแดนดังกล่าวไม่มีกฎหมายคุ้มครองข้อมูลส่วนบุคคลใกล้เคียงกับเขตอำนาจของท้องถิ่น เราจะทำข้อตกลงตามกฎหมายกับผู้รับข้อมูล เพื่อให้แน่ใจว่าผู้รับข้อมูลจะปกป้องข้อมูลส่วนบุคคลของคุณ โดยใช้มาตรฐานเดียวกับกฎหมายของอำนาจท้องถิ่น

7. ระยะเวลาการเก็บข้อมูลส่วนบุคคล

ก. เราจะเก็บข้อมูลส่วนบุคคลของคุณให้นานที่สุดเท่าที่จำเป็น เพื่อตอบสนองวัตถุประสงค์ของการเก็บข้อมูล (ดูหัวข้อ “วิธีการใช้ข้อมูลส่วนบุคคล”) ยกเว้นในกรณีที่จำเป็นตามกฎหมายกำหนด

8. การปรับปรุงนโยบายความเป็นส่วนตัว

ก. เราขอสงวนสิทธิ์ในการเปลี่ยนแปลงนโยบายความเป็นส่วนตัวนี้ได้ตลอดเวลา การเปลี่ยนแปลงจะมีผลบังคับใช้ในวันที่มีผลบังคับใช้ที่ระบุไว้ในนโยบายความเป็นส่วนตัวฉบับปรับปรุง

9. สิทธิของคุณในการเข้าถึงและแก้ไขข้อมูลส่วนบุคคลของคุณ

ก. สิทธิของคุณภายใต้กฎหมายที่ใช้บังคับ รวมถึงการเข้าถึงข้อมูลส่วนบุคคลที่เราถือเกี่ยวกับคุณ สิทธิในการยืนยัน แก้ไข ลบ หรือบล็อกข้อมูลส่วนบุคคลดังกล่าว นอกจากนี้ คุณยังมีสิทธิที่จะเพิกถอนความยินยอมของคุณ โดยยื่นคำร้องเป็นลายลักษณ์อักษรโดยใช้รายละเอียดการติดต่อที่กำหนดไว้ใน ข้อ 10 ด้านล่าง

ข. ในกรณีที่เราจำเป็นต้องใช้ข้อมูลส่วนบุคคลของคุณ เพื่อส่งผลิตภัณฑ์หรือบริการแก่คุณ หากคุณไม่ให้ข้อมูลส่วนบุคคลแก่เราหรือคุณเพิกถอนความยินยอมของคุณในการใช้ และ/หรือ เปิดเผยข้อมูลส่วนตัวของคุณ เพื่อวัตถุประสงค์ดังกล่าว เราจะไม่สามารถส่งผลิตภัณฑ์และบริการที่คุณต้องการให้แก่คุณ

ค. นอกจากนี้ คุณยังมีสิทธิร้องเรียนเกี่ยวกับวิธีการจัดการใช้ข้อมูลส่วนบุคคลของคุณ โดยการส่งการร้องเรียนเป็นลายลักษณ์อักษรถึงเรา ตามรายละเอียดการติดต่อที่ระบุไว้ใน ข้อ 10 ด้านล่าง แอมเวย์จะตอบกลับการร้องเรียนของคุณภายในเวลา 30 วันนับจากวันที่ได้รับการร้องเรียน
